1. Scope
1.1 These terms and conditions of Manigley Commerce Hub, trading under the brand LUMERIX (hereinafter "Seller"), apply to all contracts that you conclude as a consumer or entrepreneur (hereinafter "Customer") with the Seller regarding the goods and/or services presented in the online shop. The inclusion of the Customer's own terms is hereby rejected, unless otherwise agreed.
1.2 A consumer within the meaning of these terms and conditions is any natural person who concludes the transaction for a purpose that can predominantly be attributed neither to their commercial nor to their independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the transaction, acts in the exercise of their commercial or independent professional activity.
2. Conclusion of contract
2.1 The product descriptions contained in the Seller's online shop (brand: LUMERIX) do not constitute binding offers, but serve as an invitation for you to submit a binding offer.
2.2 You can submit the offer using the order form integrated into the online shop. After entering your personal data, by clicking the button that completes the ordering process, you submit a legally binding contractual offer in respect of the goods and/or services contained in the shopping cart.
2.3 The Seller may accept your offer within five days:
- by sending you a written order confirmation or a confirmation in text form (e.g. by email), whereby receipt of the confirmation by you is decisive, or
- by delivering the ordered goods, whereby receipt of the goods by you is decisive, or
- by requesting you to pay (e.g. at checkout).
If several of these alternatives apply, the contract is concluded at the time when one of the alternatives first occurs. If no acceptance takes place within the stated period, the offer is deemed rejected.
2.4 If you select "PayPal Express" as the payment method during the ordering process, by clicking the final button you also issue a payment order to your payment service provider. In this case, the Seller already declares acceptance of your offer when the payment is triggered.
2.5 The period for accepting your offer begins on the day after you submit the offer and ends at the end of the fifth day after submission.
2.6 The contract text is stored by the Seller and sent to you by email, together with these GTC, after the order has been submitted. Once the order has been completed, the contract text can no longer be accessed via the website.
2.7 Before submitting the order, you can correct your entries at any time using the usual keyboard and mouse functions. Before binding submission, all entries are displayed again in a confirmation window, where they can be checked and corrected.
2.8 The German, French, English and Italian languages are available for concluding the contract.
2.9 Order processing and further communication take place by email. You are responsible for ensuring that the email address you provide is correct and that receipt of the emails is technically ensured (e.g. through appropriate settings in spam filters).
3. Prices and terms of payment
3.1 The prices stated include statutory VAT and other price components. Any additional delivery and shipping costs are stated separately in the respective product description.
3.2 Various payment options are available to you, which are stated in the Seller's online shop.
3.3 If payment in advance has been agreed, payment is due immediately after the conclusion of the contract.
3.4 If you select a payment method offered via the payment service "Shopify Payments", payment is processed via the payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter "Stripe"). The individual payment methods offered via Shopify Payments are communicated to you in the online shop. To process payments, Stripe may use other payment services, for which special payment conditions may apply, of which you may be informed separately. Further information on "Shopify Payments" is available at https://www.shopify.com/legal/terms-payments-de.
3.5 If you select the payment method "PayPal", payment is processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal terms of use, available at https://www.paypal.com/ch/webapps/mpp/ua/useragreement-full?locale.x=de_CH. Among other things, this requires that you open a PayPal account or already have such an account.
4. Delivery, shipping and return conditions
4.1 Delivery is made to the address you provide during the ordering process. Shipping is currently possible to the following countries: Switzerland, Liechtenstein, Germany, Austria and France. Self-collection is not possible for logistical reasons.
4.2 Delivery usually takes 2–5 working days from receipt of payment for deliveries within Switzerland and to Liechtenstein, and 5–10 working days from receipt of payment for deliveries to the other delivery countries. The stated delivery times are non-binding unless they have been expressly guaranteed as binding.
4.3 If you have ordered items with different delivery times, they are shipped in a single consignment unless otherwise agreed. In this case, the delivery time is based on the item with the longest delivery time.
4.4 If delivery cannot take place due to circumstances for which you are responsible – in particular due to an incorrect, incomplete or undeliverable delivery address or absence at the time of delivery – you bear the resulting additional costs, in particular for return shipping, re-shipping or additional handling. The Seller reserves the right to invoice these costs separately. Re-delivery will only take place after receipt of the additional shipping costs incurred.
4.5 The risk of accidental loss and accidental deterioration of the goods passes to you upon handover to the shipping company.
Right of withdrawal for EU customers
4.6 If you are resident in a member state of the European Union (e.g. Germany, Austria or France), you have a statutory right of withdrawal of 14 days from receipt of the goods.
Voluntary 30-day return guarantee
4.7 Independently of the statutory right of withdrawal, we offer all customers a voluntary 30-day return and exchange guarantee from the order date – for all delivery countries.
Conditions:
- The goods must be returned undamaged and in their original packaging. If the original packaging is missing, or the goods are damaged or show signs of use, we will deduct up to 20% from the refund amount for the loss in value. This deduction applies to the voluntary return guarantee, not to the statutory right of withdrawal under section 4.6.
- You bear the cost of return shipping, except in the case of a proven defect.
- In the case of defects, please contact our support team at support@lumerix.ch – with a description and photo or video evidence.
- After examining the defect, we will offer either a replacement or a refund.
- In the case of unjustified returns or signs of use, we reserve the right to charge return shipping, handling or disposal costs.
5. Liability for defects
Statutory liability for defects applies.
6. Applicable law, place of jurisdiction
6.1 If you act as a consumer, all legal relationships between the parties are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG); the exclusive place of jurisdiction for all disputes arising from this contract is your place of residence.
6.2 If you act as an entrepreneur, the exclusive place of jurisdiction for all disputes arising from this contract is the Seller's place of residence or registered office.
